Terms and Conditions

Welcome to Fenixx In Flow, LLC. These Terms and Conditions govern your access to and use of the Fenixx In Flow website, appointment-booking systems, communications, wellness services, programs, events, and related offerings.

By accessing our website, booking an appointment, purchasing a service, registering for a program, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

If you do not agree to these terms, please do not use our website or services.

1. About Fenixx In Flow

Fenixx In Flow, LLC provides massage therapy, yoga, wellness education, workshops, events, corporate and community wellness programming, and related supportive wellness services.

Information provided through our website, text messages, social media pages, programs, or educational materials is intended for general informational and wellness purposes unless otherwise stated.

2. Eligibility

You must be at least 18 years old to independently book or purchase services.

Services for minors may require the consent and participation of a parent or legal guardian. Fenixx In Flow may require a parent or legal guardian to complete applicable forms, remain on the premises, or provide written authorization before services are performed.

By using our website or services, you represent that the information you provide is accurate and that you have the legal authority to enter into these Terms and Conditions.

3. Appointments and Scheduling

Appointments may be scheduled through our website, scheduling platform, telephone, text message, referral process, or directly with an authorized Fenixx In Flow representative.

An appointment is not guaranteed until it has been accepted or confirmed by Fenixx In Flow.

Clients are responsible for reviewing appointment confirmations and ensuring that the selected date, time, service, provider, and location are correct.

Fenixx In Flow may reschedule, modify, or cancel an appointment because of provider availability, emergencies, unsafe conditions, severe weather, facility issues, illness, administrative requirements, or circumstances outside our reasonable control.

When reasonably possible, we will notify the affected client and offer available rescheduling options.

4. Arrival and Late Appointments

Clients should arrive on time and complete all required forms before the scheduled service begins.

A grace period may be provided at the discretion of Fenixx In Flow. Late arrival may result in:

  • A shortened session;

  • Rescheduling of the appointment;

  • Cancellation of the appointment; or

  • The application of an applicable late-cancellation or no-show fee.

A shortened appointment caused by late arrival may still be charged at the originally scheduled rate.

Providing a grace period on one occasion does not require Fenixx In Flow to provide the same accommodation in the future.

5. Cancellations, Rescheduling, and No-Shows

Clients should provide as much notice as possible when cancelling or rescheduling an appointment.

The cancellation timeframe, cancellation fee, deposit requirement, and no-show charge applicable to a particular service may be stated during booking, in the appointment confirmation, on the applicable service page, or in a separate written policy.

A client who fails to appear for an appointment or cancels outside the permitted cancellation period may:

  • Lose an appointment deposit;

  • Be charged a late-cancellation or no-show fee;

  • Be required to prepay for future appointments; or

  • Have future scheduling privileges limited.

Fees may be waived or adjusted at the discretion of Fenixx In Flow based on emergencies, documented circumstances, insurance requirements, or other relevant considerations.

6. Payments

Payment is due in full before the scheduled session begins unless another arrangement has been approved in advance by Fenixx In Flow.

Clients are expected to complete payment online through the approved booking or payment platform before their appointment. Cash, insurance billing, vouchers, third-party payments, payment plans, or other payment methods may be accepted only when specifically agreed upon by Fenixx In Flow.

An appointment may be delayed, rescheduled, or cancelled if payment has not been received before the session and no alternative arrangement has been approved.

By submitting a payment method, you represent that you are authorized to use it and authorize Fenixx In Flow and its payment processors to charge the amount due.

Prices, packages, promotional offers, and service availability may change at any time. Price changes will not normally affect services that have already been purchased unless an error, expired offer, insurance adjustment, or other disclosed condition applies.
 

Clients remain responsible for unpaid balances, noncovered services, denied claims, deductibles, copayments, coinsurance, late fees, no-show fees, and other amounts not paid by an insurer or third-party payer, unless prohibited by an applicable contract or law.

7. Insurance and Third-Party Benefits

Fenixx In Flow may accept certain insurance benefits, healthcare network authorizations, referrals, employer benefits, vouchers, sponsorships, or third-party payment arrangements.

Acceptance of insurance information, a referral, or an authorization does not guarantee payment.

Coverage depends on the client’s plan, eligibility, authorization, medical necessity requirements, referral terms, service limits, and the payer’s rules.

Clients are responsible for:

  • Providing complete and accurate insurance information;

  • Maintaining valid coverage;

  • Obtaining required referrals or authorizations;

  • Informing Fenixx In Flow of coverage changes;

  • Confirming benefits when necessary; and

  • Paying amounts determined to be the client’s responsibility.

A benefits estimate is not a guarantee of coverage or payment.

If a claim is denied, reduced, recouped, or determined not to be covered, the client may be responsible for the applicable balance unless another agreement or law provides otherwise.

8. Health Information and Client Responsibilities

Clients must provide complete and accurate information concerning their health history, medications, injuries, allergies, pregnancy status, recent surgeries, medical restrictions, pain, symptoms, and other conditions that may affect participation in services.

Clients must promptly inform their provider of:

  • New or worsening pain;

  • Dizziness, numbness, shortness of breath, or discomfort;

  • A recent injury or medical procedure;

  • A change in diagnosis or medication;

  • A pregnancy or possible pregnancy;

  • An infectious or contagious condition; or

  • Any concern about the safety or suitability of a service.

Fenixx In Flow may decline, modify, pause, or discontinue a service when a provider believes the service may be unsafe, inappropriate, outside the provider’s scope of practice, or contrary to professional standards.

A medical clearance or referral may be required before services are provided or continued.

9. Nature of Massage Therapy and Wellness Services

Massage therapy, yoga, stretching, breathwork, wellness education, and related services are intended to support relaxation, mobility, stress management, body awareness, comfort, and general well-being.

Unless provided by an appropriately licensed healthcare professional acting within that professional’s scope, these services are not a substitute for medical diagnosis, emergency care, psychotherapy, physical therapy, or treatment from a physician or other qualified healthcare provider.

Fenixx In Flow does not guarantee that a particular service will cure, prevent, diagnose, or treat a medical or mental-health condition.

Individual experiences and outcomes vary.

Clients should consult an appropriate healthcare professional regarding symptoms, medical concerns, contraindications, or decisions about treatment.

10. Informed Participation and Assumption of Risk

Participation in massage therapy, movement, stretching, yoga, workshops, retreats, events, and other wellness activities may involve physical contact, movement, changes in position, exertion, emotional responses, soreness, fatigue, temporary discomfort, or other inherent risks.

By voluntarily participating, you acknowledge that:

  • You are responsible for communicating your comfort level and physical limitations;

  • You may decline or stop any activity at any time;

  • You should not participate while impaired or when participation would be medically unsafe;

  • You will follow reasonable safety instructions; and

  • No particular result has been promised.

Nothing in these Terms and Conditions releases Fenixx In Flow from responsibility that cannot legally be limited or waived.

Separate intake, consent, participation, or liability forms may be required for particular services, programs, or events.

11. Professional Boundaries and Client Conduct

Fenixx In Flow maintains professional, respectful, and therapeutic boundaries.

Sexual, threatening, discriminatory, harassing, abusive, violent, or otherwise inappropriate behavior will not be tolerated.

Services may be ended immediately if a client:

  • Makes sexual requests or inappropriate comments;

  • Intentionally exposes themselves outside the reasonable requirements of a service;

  • Threatens or harasses a provider, staff member, contractor, guest, or participant;

  • Appears intoxicated or impaired;

  • Refuses to follow safety instructions;

  • Provides materially false information;

  • Creates an unsafe or disruptive environment; or

  • Engages in unlawful conduct.

When a session is ended because of client misconduct, the client may remain responsible for the full appointment charge and may be prohibited from booking future services.

Fenixx In Flow may contact law enforcement, emergency services, building security, a healthcare professional, or another appropriate authority when reasonably necessary to protect health or safety.

12. Draping, Touch, and Consent

Massage therapy and certain wellness services involve professional touch.

Appropriate draping practices will be used during massage therapy. Only the area being addressed should be uncovered in accordance with professional standards, client consent, and applicable law.

Clients may request modifications, ask questions, decline work on a particular area, or stop the session at any time.

Consent may be withdrawn at any point.

Consent to one service, technique, body area, or appointment does not constitute consent to every service, technique, body area, or future appointment.

13. Electronic Communications

By providing an email address or telephone number, you authorize Fenixx In Flow to use that information for communications you request or that are reasonably related to your inquiry, appointment, account, payment, referral, authorization, program, or service.

Communications may include:

  • Appointment confirmations and reminders;

  • Scheduling and rescheduling notices;

  • Intake or documentation requests;

  • Service updates;

  • Payment and account notices;

  • Insurance or authorization communications;

  • Follow-up communications;

  • Customer-service responses; and

  • Other communications for which you have provided consent.

Standard email and text messaging are not always secure. Do not use text or email for emergencies or for highly sensitive information unless you understand and accept the associated risks.

Recipients may opt in to receive text messages from Fenixx In Flow by texting JOIN to:

Recipients may also provide express consent through an approved booking form, intake form, registration form, website form, or direct written consent process that includes the applicable SMS disclosure.

Types of Messages

Text messages may include:

  • Appointment confirmations;

  • Appointment reminders;

  • Scheduling or rescheduling updates;

  • Cancellation notices;

  • Follow-up messages;

  • Documentation requests;

  • Service-related notices;

  • Customer-support responses; and

  • Other communications described when consent is requested.

Message Frequency

Message frequency varies based on appointments, inquiries, services, and client activity.

Charges

Message and data rates may apply according to the recipient’s mobile service plan.

Opting Out

Recipients may opt out at any time by replying STOP.

After an opt-out request is processed, the recipient may receive one final message confirming that they have been unsubscribed. No additional automated text messages will be sent unless the recipient provides consent again.

Fenixx In Flow will also honor other reasonable requests that clearly communicate the recipient’s desire to stop receiving text messages.

Consent Is Optional

Consent to receive automated or promotional text messages is not a condition of purchasing goods or services.

Mobile Information

Mobile phone numbers, SMS consent records, and opt-in information will not be sold, rented, or shared with third parties or affiliates for their independent marketing or promotional purposes.

Information may be provided to vendors that help Fenixx In Flow deliver communications, operate its systems, process appointments, support clients, or comply with legal obligations. Such providers may use the information only to perform authorized services on behalf of Fenixx In Flow.

Mobile carriers are not responsible for delayed or undelivered messages.

15. Email Communications

Clients may receive transactional emails associated with appointments, inquiries, payments, accounts, programs, referrals, or services.

Marketing emails will include an unsubscribe method when required. Unsubscribing from promotional emails may not prevent receipt of necessary transactional or account-related communications.

16. Privacy

Use of personal information is governed by the Fenixx In Flow Privacy Policy, which is incorporated into these Terms and Conditions by reference.

17. Website Content

The information appearing on the Fenixx In Flow website is provided for general informational, educational, and promotional purposes.

Although we work to keep information accurate and current, we do not guarantee that every description, price, availability statement, image, schedule, provider listing, policy, or other item will always be complete, current, or error-free.

We may correct errors, modify content, update policies, or remove information at any time.

Website content should not be relied upon as emergency, medical, legal, financial, or mental-health advice.

18. Emergency Situations

Fenixx In Flow does not provide emergency medical or crisis-response services through its website, email, social media accounts, booking system, or text messaging number.

Do not use these channels for an emergency.

In a medical or safety emergency, call 911 or contact an appropriate emergency-service provider.

19. Intellectual Property

Unless otherwise stated, the Fenixx In Flow website and its original content—including text, graphics, branding, logos, photographs, videos, program materials, exercises, workbooks, designs, downloads, service descriptions, trademarks, and other materials—are owned by or licensed to Fenixx In Flow, LLC or its affiliated rights holders.

You may access materials for your own lawful, personal, noncommercial use.

You may not copy, reproduce, republish, sell, distribute, modify, create derivative works from, publicly display, commercially exploit, or remove ownership notices from protected materials without prior written permission.

No license or ownership interest is transferred merely because you access the website, purchase a service, attend a program, or receive materials.

20. User Submissions and Reviews

When you voluntarily submit a review, testimonial, comment, photograph, video, or other content, you represent that:

  • You created or have the right to submit it;

  • It does not violate another person’s rights;

  • It is not unlawful, threatening, defamatory, deceptive, or obscene; and

  • Any individuals identifiable in the content have provided appropriate permission.

Fenixx In Flow will not use a client’s image, testimonial, treatment information, or protected health information for public marketing without any consent required by applicable law or professional obligations.

Permission to use a submission may be addressed in a separate media release or written authorization.

21. Third-Party Websites and Services

Our website may link to scheduling systems, payment processors, insurance networks, social media platforms, maps, educational resources, partner organizations, or other third-party services.

Fenixx In Flow does not control every third-party platform and is not responsible for its independent content, security practices, availability, terms, or privacy practices.

Use of a third-party service may be governed by that provider’s own terms and policies.

A link or reference does not necessarily constitute an endorsement.

22. Gift Certificates, Packages, and Promotions

Gift certificates, prepaid packages, vouchers, discounts, and promotional offers are subject to the conditions disclosed when issued or purchased.

Unless otherwise stated:

  • Offers may not be combined;

  • Discounts have no cash value;

  • Services remain subject to availability;

  • Transfers may require written approval;

  • Promotional value may expire where permitted by law; and

  • Refunds are subject to the applicable purchase terms and legal requirements.

Fenixx In Flow may refuse a certificate, voucher, or promotional code that is invalid, altered, duplicated, obtained through fraud, or used contrary to its stated terms.

23. Events, Workshops, Retreats, and Group Programs

Programs and events may have additional registration, payment, cancellation, travel, conduct, participation, photography, or assumption-of-risk terms.

Those additional terms are incorporated into these Terms and Conditions when presented during registration.

Schedules, presenters, locations, activities, and program content may change because of availability, weather, enrollment, travel interruptions, safety needs, or other circumstances.

Unless expressly stated otherwise, participants are responsible for their transportation, lodging, meals, personal property, travel documentation, medical needs, and other expenses.

24. Corporate, Community, and Partner Services

Services provided to employers, schools, agencies, nonprofit organizations, healthcare organizations, community groups, military or veteran organizations, and other partners may be governed by a separate proposal, memorandum, service agreement, purchase order, contract, or statement of work.

When a written organizational agreement conflicts with these website Terms and Conditions, the signed organizational agreement will control for the applicable services.

25. Service Availability

Fenixx In Flow does not guarantee that every service, provider, location, appointment time, insurance arrangement, program, or website feature will remain available.

We may modify, suspend, replace, discontinue, restrict, or expand services at any time.

26. Refusal or Discontinuation of Services

To the extent permitted by law and applicable contractual obligations, Fenixx In Flow may refuse, suspend, or discontinue services because of:

  • Safety concerns;

  • Inappropriate conduct;

  • Repeated missed appointments;

  • Unpaid balances;

  • Scope-of-practice limitations;

  • Medical contraindications;

  • Provider availability;

  • Failure to complete required documentation;

  • Fraud, misuse, or misrepresentation;

  • Violation of these terms; or

  • Breakdown of the professional relationship.

When appropriate, clients may be encouraged to seek another provider or a different level of care.

27. Disclaimer of Warranties

To the fullest extent permitted by law, the website, content, and services are provided on an “as available” basis.

Fenixx In Flow does not make guarantees regarding:

  • Uninterrupted website access;

  • Error-free electronic communications;

  • Insurance approval or payment;

  • Appointment availability;

  • Specific health, wellness, financial, professional, or personal outcomes; or

  • The suitability of a particular service for every individual.

Nothing in this section excludes warranties or protections that cannot legally be excluded.

28. Limitation of Liability

To the fullest extent permitted by law, Fenixx In Flow and its owners, employees, contractors, providers, representatives, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the website or services.

This limitation does not apply to liability that cannot legally be limited, including liability arising from conduct for which limitation is prohibited by law.

Any separate professional consent, participation, insurance, or service agreement may include additional provisions applicable to a specific service.

29. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from your unlawful conduct, material violation of these terms, infringement of another person’s rights, fraudulent activity, or misuse of the website or services.

This section does not require you to indemnify Fenixx In Flow for liability caused solely by conduct for which indemnification is prohibited by law.

30. Governing Law and Venue

These Terms and Conditions are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, legal proceedings relating to these terms or services must be brought in a court of appropriate jurisdiction serving the area in Georgia where Fenixx In Flow is principally located.

Before filing a legal claim, the parties are encouraged to attempt in good faith to resolve the issue through direct written communication.

31. Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will remain in effect.

32. No Waiver

Failure by Fenixx In Flow to enforce a provision on one occasion does not waive the right to enforce that provision later.

A waiver is effective only when made in writing by an authorized representative.

33. Entire Agreement

These Terms and Conditions, together with the Privacy Policy and any applicable booking terms, consent forms, intake forms, service agreements, insurance documents, event terms, or signed contracts, constitute the agreement governing the applicable use of Fenixx In Flow services.

A specific signed agreement will control if it expressly conflicts with these general website terms.

34. Changes to These Terms

Fenixx In Flow may revise these Terms and Conditions periodically.

Changes become effective when the updated terms are posted with a revised effective date, unless a different date is stated.

Continued use of the website or services after updated terms become effective constitutes acceptance of the revised terms to the extent permitted by law.

Material changes to SMS terms will not eliminate a recipient’s right to opt out.
